Meshekh Chokhmah – Mishpatim – Personal and National Religion

What happened between Shemos 24:3 “kol hadevarim asher diber Hashem na’aseh” and v. 7 “kol asher diver Hashem na’aseh venishmah”? Why did we accept the Torah twice, using two different terminologies?

וַיָּבֹ֣א מֹשֶׁ֗ה וַיְסַפֵּ֤ר לָעָם֙ אֵ֚ת כָּל־דִּבְרֵ֣י ה֔׳ וְאֵ֖ת כָּל־הַמִּשְׁפָּטִ֑ים וַיַּ֨עַן כָּל־הָעָ֜ם ק֤וֹל אֶחָד֙ וַיֹּ֣אמְר֔וּ כָּל־הַדְּבָרִ֛ים אֲשֶׁר־דִּבֶּ֥ר ה֖׳ נַעֲשֶֽׂה׃ ג – 3 Moses went and repeated to the people all of Hashem’s statements and all the laws; and all the people answered with one voice, saying, “All the things that Hashem has stated we will do!”
וַיִּכְתֹּ֣ב מֹשֶׁ֗ה אֵ֚ת כָּל־דִּבְרֵ֣י ה֔׳ וַיַּשְׁכֵּ֣ם בַּבֹּ֔קֶר וַיִּ֥בֶן מִזְבֵּ֖חַ תַּ֣חַת הָהָ֑ר וּשְׁתֵּ֤ים עֶשְׂרֵה֙ מַצֵּבָ֔ה לִשְׁנֵ֥ים עָשָׂ֖ר שִׁבְטֵ֥י יִשְׂרָאֵֽל׃ ד – 4 Moses then wrote down all of Hashem’s statements; and he arose early in the morning, and built altar at the foot of the mountain, with twelve pillars for the twelve tribes of Israel.
וַיִּשְׁלַ֗ח אֶֽת־נַעֲרֵי֙ בְּנֵ֣י יִשְׂרָאֵ֔ל וַיַּֽעֲל֖וּ עֹלֹ֑ת וַֽיִּזְבְּח֞וּ זְבָחִ֧ים שְׁלָמִ֛ים לַה֖׳ פָּרִֽים׃ ה – 5 He designated some young men among the Israelites, and they offered ascension offerings and sacrificed bulls as offerings of well-being to Hashem.
וַיִּקַּ֤ח מֹשֶׁה֙ חֲצִ֣י הַדָּ֔ם וַיָּ֖שֶׂם בָּאַגָּנֹ֑ת וַחֲצִ֣י הַדָּ֔ם זָרַ֖ק עַל־הַמִּזְבֵּֽחַ׃ ו – 6

Moses took a part of the blood and put it in basins, and part of the blood he dashed against the altar.

וַיִּקַּח֙ סֵ֣פֶר הַבְּרִ֔ית וַיִּקְרָ֖א בְּאָזְנֵ֣י הָעָ֑ם וַיֹּ֣אמְר֔וּ כֹּ֛ל אֲשֶׁר־דִּבֶּ֥ר ה֖׳ נַעֲשֶׂ֥ה וְנִשְׁמָֽע׃ ז– 7 Then he took the book of the covenant and read it into the people’s ears; and they said, “All that Hashem has spoken we will do and we will listen!”

וַיְסַפֵּ֤ר לָעָם֙ אֵ֚ת כָּל־דִּבְרֵ֣י ה֔׳ וְאֵ֖ת כָּל־הַמִּשְׁפָּטִ֑ים. דהוא נמוסים שדעת האדם נותן עליהם, אבל לכוף ולרדות על חוקי התורה וגדריה הוא רק מצד שכל ישראל ערבים זה בזה[1], ואם יעבור אחד הוא מזיק לחבירו ולהכלל כולו. בזה יש לבית דין לכוף ולשפוט העובר את מצות השי”ת.

דבלא זה אין זה מהראוי שיתערב אחר במה שיש להאדם עם קונו, לכן מקודם אמרו “כָּל־הַדְּבָרִ֛ים אֲשֶׁר־דִּבֶּ֥ר ה֖׳ נַעֲשֶֽׂה” ולא קבלו עדיין המשפטים, אבל כי זרק הדם על העם להכניסן בברית וכמו דאמרו במכילתא יתרו,

[וַיִּקַּח֙ סֵ֣פֶר הַבְּרִ֔ית וַיִּקְרָ֖א בְּאָזְנֵ֣י הָעָ֑ם. אבל לא שמענו מהיכן קרא באזניהם. רבי יוסי בר’ יהודה אומר, מתחלת בראשית ועד כאן; רבי אומר, מצוות שנצטווה אדם הראשון ומצוות שנצטוו בני נח ומצוות שנצטוו במצרים ובמרה ושאר כל המצוות כולן. – ר’ ישמעאל אומר, בתחלת הענין מה הוא אומר, (ויקרא כה) ושבתה הארץ שבת לה’ – שש שנים תזרע שדך וגו’, שמטים ויובלות ברכות וקללות; בסוף הענין מה הוא אומר, (שם כו) אלה החוקים והמשפטים והתורות. אמרו מקבלין אנו עלינו, כיון שראה שקבלו עליהם נטל הדם וזרק על העם, שנאמר] (שמות כד) ויקח משה את הדם ויזרק על העם. אמר להם, הרי אתם קשורים ענובים תפוסים, מחר בואו וקבלו עליכם המצות כולן. [ר’ יוסי בר’ יהודה אומר, בו ביום נעשו כל המעשים.]

וזה ספר הברית שכרתו כל ישראל יחד, לכן אמרו [פסוק ז׳] “כֹּ֛ל אֲשֶׁר־דִּבֶּ֥ר ה֖׳” בין הדברים בין המשפטים נעשה, שהעובר מצות ד’ הוא גדר בין אדם לחבירו שמזיק להכלל

[1] ערבים זה בזהThis version with a beis is found in Shevuos 39a; Sanhedrin 27b; Rashi, Nedarim 13b; and Tosafos, Yevamos 47b. “לזה”, with a lamed is first found in Rashi, Vayikra 26:47, but there Rashi is quoting the Toras Kohanim ad loc., which has “בזה.” Siddur Rashi §381 has “mizeh—from another,” and I’m not sure what to make of that. But, the preposition changes how we take the word “ערבים” as well. With a lamed, the phrase means “All Jews are guarantors, one for the other.” With a beis — “All Jews are intermixed, one in the other.” The latter is almost certainly the original intent.

  1. It’s not there throat of your thought but yes, the bazeh lazeh thing is interesting. It has supplanted the original.
